This is an appeal by the plaintiff-appellant from the district court's order overruling her motion for a new trial in an action arising out of a rear end automobile collision. At the time of the collision, appellant had stopped her automobile on the inside traffic lane of a four-lane thoroughfare in Salina. Her vehicle was struck from the rear by defendant-appellee's station wagon. The point of impact was approximately 93 feet south of an intersection. Plaintiff alleged she sustained permanent bodily injuries and damages to her automobile as the proximate result of the defendant's negligence in failing to maintain a proper lookout; in driving at an excessive speed, and in failing to keep his automobile under control to avoid the collision. Defendant contended he was traveling at approximately five miles an hour at the time of the collision; that he was not negligent, and that the plaintiff was not injured as she alleged. Contributory negligence was not an issue. The jury returned a general verdict for the defendant.
